Terms of Service

1. Acceptance of Terms
By accessing or utilizing the Clientele platform, digital properties, and AI-powered services, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an organization, you represent that you have the authority to bind that entity. If you do not agree to these terms, you must discontinue use of our services immediately.
2. Services Description
Clientele engineers and deploys autonomous AI ecosystems purpose-built for service-based businesses. Our infrastructure includes intelligent lead qualification, automated pipeline orchestration, lead nurturing, and client acquisition systems. Service scope, deliverables, and deployment timelines are defined during the architecture consultation and formalized in your engagement agreement.
3. SMS Use Cases
By opting in to receive SMS messages from Clientele, you may receive messages related to the following: appointment reminders and consultation scheduling, service updates and deployment status notifications, promotional offers and special announcements, account notifications and follow-up communications, and responses to your inquiries or support requests. Message frequency may vary depending on your engagement level and preferences.
4. Opt-Out Instructions
You may opt out of receiving SMS messages from Clientele at any time by replying STOP to any message you receive from us. Upon receiving your opt-out request, we will confirm your removal and cease sending SMS messages within a reasonable timeframe. You may also opt out by contacting us directly at the support information provided below. Opting out of SMS communications will not affect any other services or communications under your engagement agreement.

For any questions, concerns, or support requests related to our SMS messaging program or any other services, please contact us by emailing support@clientele.agency or by reaching out to your designated Clientele lead engineer. We are committed to responding to all inquiries promptly.
6. Message & Data Rate Disclosure
Standard message and data rates may apply to any SMS messages sent to or received from Clientele, depending on your mobile carrier and service plan. Clientele is not responsible for any messaging or data charges incurred by your mobile carrier. Please contact your wireless provider for details regarding your text messaging and data plan.
7. Carrier Liability Disclaimer
Clientele and mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network provider. Carriers are not responsible for the content of any SMS messages sent by Clientele. Clientele makes no guarantees regarding the availability, timeliness, or accuracy of SMS message delivery.
8. Age Restriction
You must be at least 18 years of age to use Clientele services or to opt in to our SMS messaging program. By using our services or providing your phone number for SMS communications, you confirm that you are 18 years of age or older. If we become aware that a person under 18 has provided personal information or opted in to SMS messaging, we will take steps to remove that information and terminate any related communications.
9. User Obligations
You agree to provide accurate and complete information when submitting a Deployment Brief or engaging with our consultation pipeline. You are responsible for maintaining the confidentiality of any credentials or access tokens issued to your organization. You shall not attempt to reverse-engineer, decompile, or extract proprietary logic from any Clientele-built system, agent, or automation deployed on your behalf.
10. Intellectual Property
All system architectures, AI models, automation frameworks, proprietary tooling, and methodologies developed by Clientele remain the exclusive intellectual property of Clientele. Client-specific configurations and data integrations are licensed for use within the scope of your active engagement. Upon termination, access to proprietary Clientele infrastructure and tooling will be revoked.
11. Payment & Billing
Fees for Clientele services are outlined in your engagement agreement. All payments are due according to the schedule specified in your contract. Late payments may result in suspension of services and revocation of access to deployed systems. Clientele reserves the right to adjust pricing for future engagement periods with reasonable advance notice.
12. Limitation of Liability
Clientele provides its services on an "as-is" basis and makes no guarantees regarding specific revenue outcomes, lead conversion rates, or deal closures. To the maximum extent permitted by law, Clientele shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our platform or services. Our total liability shall not exceed the fees paid by you during the twelve months preceding the claim.
13. Termination
Either party may terminate an engagement in accordance with the terms specified in the signed agreement. Clientele reserves the right to suspend or terminate access to services immediately if you breach these Terms, engage in fraudulent activity, or use our systems in a manner that compromises infrastructure integrity. Upon termination, all deployed automations and integrations will be decommissioned within the agreed-upon wind-down period.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these terms or your use of Clientele services shall be resolved through binding arbitration, unless otherwise agreed upon in your engagement contract.
15. Modifications
Clientele reserves the right to update these Terms of Service at any time. Material changes will be communicated through our platform or via direct correspondence to active clients. Continued use of our services following any modifications constitutes acceptance of the updated terms.
